The following Privacy Policy sets out the rules for saving and accessing data on the Devices of Users using the Website for the purposes of using services provided electronically by the Controller and the rules for collecting and processing Users’ personal data that were provided by them personally and voluntarily via the tools available on the Website.

The following Privacy Policy is an integral part of the powerprm.com website and defines the rules, rights and obligations of Users using the Website.

§1 Definitions

  1. Website – the ” PowerPRM Sp. z o.o. ” website operating at powerprm.com;
  2. External website – websites of partners, service providers or service recipients cooperating with the Controller;
  3. Controller – the Website administrator and Personal data Controller (hereinafter referred to as the Controller) is the company “PowerPRM Sp. z o.o.”, operating at the following address: Szamocka 8, 01-748, Warsaw, with the assigned tax identification number (NIP): 5252923988, with the KRS number: 0000992560, providing services electronically via the Website;
  4. User – a natural person for whom the Controller provides services electronically via the Website;
  5. Device – an electronic device with software through which the User gains access to the Website;
  6. Cookies – text data collected in the form of files placed on the User’s Device;
  7. GDPR – Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation data);
  8. Personal data – means information about an identified or identifiable natural person (“data subject”); an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, the economic, cultural or social identity of the individual;

Processing – means an operation or set of operations performed on personal data or sets of personal data, whether or not by automated means, such as collecting, recording, organizing, structuring, storing, adapting or modifying, downloading, viewing, using, disclosing by sending, disseminating or otherwise such sharing, alignment or combination, restriction, erasure or destruction;
  10. Profiling – means any form of automated processing of personal data, which involves the use of personal data to evaluate certain personal factors of a natural person, in particular to analyze or predict aspects relating to that natural person’s work performance, economic situation, health, personal preferences, interests, reliability , behavior, location or movement;
  11. Consent – consent of the data subject means any freely given, specific, informed and unambiguous indication of the data subject’s wishes by which the data subject, by means of a statement or a clear affirmative action, signifies agreement to the processing of personal data concerning him or her;
  12. Anonymization – anonymization of personal data is an irreversible process of data operations that destroys / overwrites personal data, making it impossible to identify or link a given record with a specific User or natural person;
  13. Contact Form – an interactive form available on the Website, which allows Users to directly contact the Controller.

§2 Types of Cookies

Cookies that are used on the Website:

  1. Internal cookies – files placed and read from the User’s Device by the Website’s IT system;
  2. External cookies – files placed and read from the User’s Device by the IT systems of external websites. Scripts of external websites that may place Cookies on User’s Devices have been consciously placed on the Website through scripts and services made available and installed on the Website;
  3. Session cookies – files placed and read from the User’s Device by the Website during one session of a given Device. After the session ends, the files are deleted from the User’s Device;
  4. Persistent cookies – files placed and read from the User’s Device by the Website until they are manually deleted. Files are not deleted automatically after the end of the Device session, unless the configuration of the User’s Device is set to delete Cookies after the end of the Device session.

§3 Security of Data Storage

  1. Mechanisms for storing and reading cookies – Mechanisms for storing, reading and exchanging data between cookies saved on the User’s Device and the Website are implemented through built-in mechanisms of web browsers and do not allow downloading other data from the User’s Device or data from other websites visited by the User, including Personal data or confidential information. It is also practically impossible to transfer viruses, trojan horses and other worms to the User’s Device.
  2. Internal cookies – cookies used by the Controller are safe for Users’ Devices and do not contain scripts, content or information that may threaten the security of Personal data or the security of the Device used by the User.
  3. External cookies – the Controller takes all possible actions to verify and select website partners in the context of Users’ security. The Controller selects well-known, large partners with global social trust for cooperation – however, he does not have full control over the content of cookies from external partners. The Controller is not responsible for the security of Cookie files, their content and the license-compliant use by scripts installed on the website from external websites, to the extent permitted by law. The list of partners is provided further in the Privacy Policy.

  • Threats on the User’s side – the Controller uses all possible technical measures to ensure the security of data stored in cookies. However, it should be noted that ensuring the security of this data depends on both parties, including the User’s activity. The Controller is not responsible for intercepting this data, impersonating the User’s session or deleting it as a result of the User’s conscious or unconscious activity, viruses, trojan horses and other spyware that may or may have infected the User’s Device. In order to protect themselves against these threats, users should follow the principles of safe use of the Internet.
  • Storage of Personal data – the Controller ensures that it makes every effort to ensure that the processed Personal data entered voluntarily by Users are safe, access to them is limited and in accordance with their purpose and processing purposes. The Controller also ensures that it makes every effort to protect its data against loss by using appropriate physical and organizational security measures.

  • Art. 6 (1) (f) GDPR – in order to implement the legitimate interest of the Controller, consisting in ensuring the security of the Website and determining, investigating or defending against claims.
  • Art. 6 (1) (a) GDPR – to send the Controller’s marketing materials.

User data collected anonymously and automatically is processed for the following purposes:

  • Conducting statistics and analyzes regarding the Website,
  • Improving the Website.

§6 Cookies of external websites

The Controller uses JavaScript and web components of partners on the Service, which can place their own cookies on the User’s Device. Remember that in your browser settings you can decide on the cookies that can be used by individual websites. §7 Types of data collected

The website collects Personal data about Users. Some of the data is collected automatically and anonymously, and some of the data is Personal data provided voluntarily by Users when using individual services offered by the Website. Below we present the scope of these data and Personal data:

To run the website, the Controller uses the services of an external hosting provider, VPS or Dedicated Servers – Zenbox. All data collected and processed on the Website are stored and processed in the service provider’s infrastructure located within the European Economic Area

§9 Method of processing Personal data

Personal data provided voluntarily by Users:

  • Personal data will not be transferred outside the European Economic Area.
  • Personal data is used for automated decision-making (including profiling).
  • Personal data will not be resold to third parties, however, if the User gives consent, the Controller may transfer Personal data to its partners.

Anonymous data collected automatically:

  • Anonymous data will be transferred outside the European Economic Area.
  • Anonymous data will not be used for automated decision-making (including profiling).
  • Anonymous data will not be sold to third parties.

§10 Personal data processing period

Personal data provided voluntarily by Users:

As a rule, the indicated Personal data are stored only for the period of provision of the service on the Website by the Controller. They are deleted or anonymized within 30 days from the end of the provision of services (e.g. unsubscribing from the Newsletter list). An exception is a situation that requires securing the Controller’s legitimate interests (e.g. to establish, defend or pursue claims or ensure the security of the Website). In such a situation, the Controller will store the indicated Personal data until the limitation period for claims arising from the use of services provided via the Website.

Anonymous data collected automatically:

Anonymous statistical data, which do not constitute Personal data, are stored by the Controller in order to maintain Website statistics for an indefinite period of time.

§11 Users' rights related to the processing of Personal data

Users whose Personal data are processed by the Controller have the following rights:

  • The right to access Personal data
    Users have the right to access their Personal data upon request submitted to the Controller
  • The right to rectify Personal data
    Users have the right to request the Controller to immediately rectify Personal data that is incorrect and/or complete incomplete Personal data, carried out upon request submitted to the Controller.
  • The right to delete Personal data Users have the right to request the Controller to immediately delete Personal data, implemented upon a request submitted to the Controller. The Controller reserves the right to suspend the execution of a request to delete data in order to protect the Controller’s legitimate interest (determining, pursuing or defending claims).
    In the case of the Newsletter service, the User has the option of deleting their Personal data themselves using the link included in each e-mail message sent.
  • The right to limit the processing of Personal data
    Users have the right to limit the processing of Personal data in the cases indicated in Art. 18 GDPR, among others questioning the accuracy of Personal data, carried out upon request submitted to the Controller.
  • The right to transfer Personal data
    Users have the right to obtain from the Controller Personal data regarding the User in a structured, commonly used, machine-readable format, implemented upon request submitted to the Controller.
  • The right to object to the processing of Personal data
    Users have the right to object to the processing of their Personal data in the cases specified in Art. 21 GDPR, carried out upon request submitted to the Controller.
  • Right to lodge a complaint
    Users have the right to lodge a complaint with the supervisory authority responsible for the protection of Personal data . A complaint may be submitted to the President of the Personal Data Protection Office (ul. Stawki 2, 00-193 Warsaw). §12 Consequences of refusing to provide Personal data

Providing Personal data is voluntary. The User decides what Personal data is made available via the Website. However, please remember that failure to provide certain information may result in the inability to use the services provided via the Website. Failure to provide certain Personal data may also affect the functionality of the Website.

  • The Controller is not liable for incorrectly functioning functions of the Website if the User limits in any way the ability to save and read Cookie files.

The Website, in particular in articles or posts, may contain links to external websites with which the Website Controller does not cooperate. The links, pages or files indicated below may be dangerous to your Device or pose a threat to the security of your data. The Controller is not responsible for the content located outside the Website.

§16 Changes to the Privacy Policy

  • The Controller reserves the right to make any changes to this Privacy Policy without the need to inform Users regarding the use and use of anonymous data or the use of cookies.
  • The Controller reserves the right to make any changes to this Privacy Policy regarding the processing of Personal data, about which it will inform Users subscribed to the Newsletter service via e-mail within 7 days of changing the Privacy Policy. Further use of the services constitutes reading and acceptance of the changes introduced to the Privacy Policy. If the User does not agree with the changes introduced, he or she should stop using the Website’s services.
